ALLOW MMDA’s TO PASS LAW FOR ENFORCEMENT OF FACEMASK WEARING- BuLog

Hon. Kwame obeng Akatii (Executive Director of BuLog)

PRESS RELEASE
April 25, 2020

BUREAU OF LOCAL GOVERNANCE
(BuLoG)

P.o. box SE 2740, Kumasi.

Bureau of local governance has suggested that the law enforcement on face mask wearing should be pass by the MMDA’s.

According to their press statement released, signed by Hon. Kwame Obeng Akatii, the executive director of BuLog on Saturday 25th April 2020 , it detailed that ,

Ever since Covid 19 appears in Ghana, the President, His Excellency Nana Addo Dankwa Akufo Addo, and His government is doing everything humanly possible to help stop the spread of the disease which is very commendable.

Looking at the measures putting in place i.e. movement of individuals, free supply of water, halfway of electricity, social distancing and others, indicating the commitment towards the fight against Covid 19, and the support of groups and individuals clearly shows that Ghana is ever ready to help its people.

However, the Greater Accra Regional Security Council (REGSEC), has issued a statement (myjoyonline.com) to “Curb the spread of Covid 19”, which is very laudable.

Unfortunately, REGSEC may/can not enforce any law on facemask wearing, because per their functions as its been stated in section 7 of the Security and Intelligence Agencies Act 1996, Act 526, they don’t have power to make laws.

According to article 19 (11) of the 1992 Constitution, no body can be convicted or punished for a criminal offence without a written law, so REGSEC should rather join hands with the Metropolitan, Municipal and District Assemblies (MMDA’s), to pass laws of which the MMDA’s have that mandates, according to section 181 of the Local Governance Act 2016, Act 936, to implement the facemask wearing measures in all the 260 Districts in Ghana.

Once again, the President can/may also go to parliament under the certificate of urgency (afrosages.com) as He did to Act 1012, or issue Executive Instruments to that effect.

Signed.

The extension became operational after he signed the Executive Instrument (EI) to give effect to the new directive.

In a series of tweets on Sunday, April 12 explaining the legalities around the EI, the Ministry of Information said; “President Akufo-Addo has signed the Executive Instrument (EI) extending the duration of the restrictions imposed under EI 64 and EI 65.

“The restrictions imposed on public gatherings, under EI 64, have been extended for a further period of two (2) weeks, with effect from Monday, 13th April, 2020.”

“As announced already, the restrictions imposed on movement of persons in Accra, Tema, Kumasi and Kasoa, under EI 65, have been extended for a further period of one week with effect from Monday.”

“All other provisions, including all exemptions in EI 64 and EI 65, are still in full force and effect,” the Ministry of Information said.

Massive communal grave dig for the corps of corona virus at UK.

New York authorities are using the Hart Island, on the outskirts of the city, to make space for the first mass burials.

The state of New York already has more confirmed cases of the coronavirus than any other country in the world, although their death toll is currently below those registered in Spain and Italy. One of the most harrowing images seen in the last few hours is that of the immense digging being completed in Hart Island to accommodate the mass graves for the city of New York as they prepare for mass burials.

Normally these kinds of graves are used to bury those who have no family or resoruces, and prisoners are used to carry out the work. However, given the spread of the pandemic amongst the prison population and the increasing amount of deaths, the state has resorted to hiring outside labour. Currently around 25 bodies arrive each day to the site, so they are also preparing for the scenario in which morgues begin to overflow.

New York remains the epicentre of the pandemic in the United States. In a single day it has registered 779 deaths, bringing the total death toll to 7,067 and 10,621 new positive cases.

The United States continues to be the leading country with the greatest number of people infected as it recently reached a total of 466,299 cases, 24,167 more than yesterday
